Texas Supreme Court to hear Oscar Ortiz v. State Farm Lloyds

The Texas Supreme Court will hear the case of Oscar Ortiz v. State Farm Lloyds at 9 a.m. on Wednesday, Feb. 20.
Oscar Ortiz files Petition for Review seeking reversal and remand of the 4th Court of Appeals decision that affirmed a trial court's order that granted State Farms' motion to reconsider denial of its motion for summary judgment.
"The court of appeals erroneously concluded that State Farm’s payment of an appraisal award foreclosed on all other damages suffered by Ortiz, including attorney’s fees and statutory penalty interest," Ortiz's brief states.
The original case revolved around a first-party insurance claim case in which Ortiz sued State Farm Lloyds over allegations of breach of contract and violations of the Texas Insurance Code.
