Nevada Supreme Court to hear Wells Fargo Bank v. CFA
The Nevada Supreme Court will hear the case of Wells Fargo Bank NA v. CFA Inc. at 1:30 p.m. Monday, Dec. 3.
The issue in the appeal includes whether the district court erred "in determining that a sewer line adjacent to appellant’s property fits within the statutory definition of appurtenance under NRS 11.2565(2)(a), such that appellant was required to file an affidavit and expert report under NRS 11.258 to support its complaint, and that appellant's failure to do so required dismissal of the complaint?" according to the court.
The original case revolved around the appellant's negligence complaint regarding the construction of sewer lateral pipes, which allegedly caused flooding in the building and damages.
