Massachusetts Supreme Court to hear June Stearns and Clifford Oliver v. Metropolitan Life Ins., et al.
The Supreme Judicial Court of Commonwealth of Massachusetts will hear the case of June Stearns and Clifford Oliver, co-executors of the estate of Wayne Oliver, v. Metropolitan Life Ins. Co., et al. at about 9 a.m. Tuesday, Dec. 4.
Stearns and Oliver asks the following question of the court: "Whether or not the Massachusetts statute of repose, G.L. c. 260, § 2B, can be applied to bar personal injury claims arising from diseases with extended latency periods, such as those associated with asbestos exposure, where defendants had knowing control of the instrumentality of injury at the time of exposure," according to the petition.
The original case revolved around injuries related to asbestos exposure.
