State of Georgia et al. vs. International Indemnity Co. and Regulatory Technologies, Inc.
The Georgia Supreme Court will hear the case of state of Georgia et al. vs. International Indemnity Co. and Regulatory Technologies, Inc. on Oct. 31.
State of Georgia appeals arise from a trial court order finding, among other things, that the state had waived sovereign immunity under certain provisions of the Insurers Rehabilitation and Liquidation Act.
On remand, the trial court vacated its prior order, re-entered the same order, and issued a certificate of immediate review. Appellants granted applications for interlocutory review, and appeals followed.
As in their first decision, state of Georgia again holds that the trial court erred in finding a waiver of sovereign immunity.
