Bombardier Transportation (Holdings) USA requests appeal in suit from Nevada Supreme Court
The Nevada Supreme Court will hear the case of Bombardier Transportation (Holdings) USA Inc. v. Nevada Labor Commissioner at 10:30 a.m. Wednesday, Sept. 5.
Bombardier appeals the denial of the petition for judicial review, arguing, among other things, that the Labor Commissioner erred in determining that the contract was a public work subject to prevailing wages and that Bombardier was not exempt from paying prevailing wages.
The original case revolved the International Union of Elevator Constructors' claim that the plaintiff's maintenance technicians are entitled to prevailing wage rates under the plaintiff's contract with a county for an automated train system at McCarran International Airport.
