Massachusetts Supreme Court to hear New England Power Generators Association case
The Massachusetts Supreme Court will hear the case of New England Power Generators Association Inc., et al. v. Department of Environmental Protection and Executive Office of Energy and Environmental Affairs at 9 a.m. Tuesday, May 8.
New England Power Generators Association Inc. et al. came to the Massachusetts Supreme Court after it argued the decision of the Supreme Judicial Court for Suffolk County. Appellants request that the Supreme Court grant its motion for judgment on the pleadings and declare the 7.74 Rules are unlawful, arbitrary and capricious, and therefore, void.
The original case revolved around Department of Environmental Protection & Executive Office of Energy and Environmental Affairs promulgated regulations - the 7.74 Rules - limiting emissions of carbon dioxide from electric generation facilities in Massachusetts.
