Oregon Supreme Court to hear Trinity v. Apex Directional Drilling LLC
The Oregon Supreme Court will hear the case of Trinity v. Apex Directional Drilling LLC at 9 a.m. Wednesday, April 11.
Apex Directional Drilling LLC came to the Oregon Supreme Court after it argued the decision of the Clackamas County court.
"Relator (Michael Lachner) filed a motion to dismiss the action against him on the basis that the guaranty agreement contained a venue clause requiring that any action on the guaranty be brought exclusively in the city and county of San Francisco, California. The trial court issued an order denying relator's motion. Relator challenged that order by filing a petition for a writ of mandamus. The Oregon Supreme Court allowed the petition and issued an alternative writ of mandamus," according to the court.
The original case revolved around a complaint for alleged breach of an equipment financing agreement and breach of a personal guaranty.
