Robert W. Downs vs. Homax Oil Sales to be heard on Jan. 23
The Wyoming Supreme Court will hear the case of Robert W. Downs vs. Homax Oil Sales Inc. at 9 a.m. on Jan. 23.
Domax appeals to the court to dismiss the trial court's ruling to provide a $250,000 damages award for lost profits as plaintiff only disclosed a single-page summary of gross revenues and never provided any computation in support of the alleged net profits amount, much less the underlying information in support of that computation. The alleged lost profits number and the supporting computation for that number were not disclosed until trial, during the testimony of plaintiff’s final witness.
The original case revolved around a claim for improperly interfering with Homax's business relationship with RKI, thereby causing Homax to lose profitable business it had expected to provide to RKI in the future.
