Hawaii Supreme Court to hear assessment appeal Dec. 19
The Hawaii Supreme Court will hear the case of LaVonne Harrison vs. Case De Emdeko Inc. at 11:15 a.m. on Dec. 19.
Harrison argued the Intermediate Court of Appeals erred in affirming the circuit court’s granting of summary judgment, finding the elevators, lanai railings and drains, reserved exclusively for the residential apartments, are “common elements” for which her commercial apartments, located entirely in a separate building, are subject to assessments.
The original case revolved around improper assessment of fees for the limited common elements of the residential elevators, lanai railings, drains, cable television and pest control expenses.
