Michigan Supreme Court considering case about insurance policy exclusions
The Michigan Supreme Court heard the case of Atlantic Casualty Insurance Co. vs. Gary Gustafson on Nov. 7.
Atlantic Casualty argued lower court rulings, maintaining that a policy exclusion entitled Exclusion of Injury to Employees, Contractors and Employees of Contractors be applied in a case. The exclusion barred coverage for bodily injury to any contractor, which Atlantic Casualty said was defined in the policy to include any property owner.
In the original case, Gustafson tendered the defense of the personal injury lawsuit against him to Atlantic Casualty, his commercial general liability insurer, after a property owner was injured while watching him do landscaping work.
