Case over whether contractor's insurer should pay for damages heads to Kentucky high court
The Kentucky Supreme Court will hear the case of Martin/Elias Properties LLC vs. Acuity, A Mutual Insurance Company at 11 a.m. Aug. 16.
The case came to the Kentucky Supreme Court after Martin/Elias Properties argued the decision of a lower court about the obligation of a contractor's insurance company to pay for damages the contractor allegedly caused.
The original case revolved around a contractor's alleged failure to build a proper foundation, which caused the property to become unstable.
